Terms of Service

1. Acceptance & Scope

By accessing or using Market Mirae ("the Service") you confirm that you are at least 16 years of age, have read and understood these Terms and our Privacy Policy, and agree to be bound by both. If you do not agree, do not use the Service.

The Service analyses public marketplace listings and produces an AI-generated assessment. The output is informational only and does not constitute purchasing, financial, or legal advice.

2. Age Restriction

The Service is intended for users aged 16 and over. We comply with GDPR Article 8 (EU minimum age 16) and exceed the US COPPA minimum of 13. By creating an account you confirm you meet this requirement. If we discover an account belongs to a person under 16, it will be deleted immediately.

3. Account & Authentication

You may sign in with Google or with an email + password. You are responsible for safeguarding your credentials. We may suspend or terminate accounts that violate these Terms, engage in abuse, or pose a security risk. We reserve the right to require re-authentication or additional verification for security purposes.

4. Subscriptions & Billing Consent

• Free tier includes 3 scans per month at no charge.
• Paid tiers grant a fixed number of scans (or unlimited) per billing month.
• Unused scans do not roll over to the next period.
• Recurring billing authorisation: By clicking "Subscribe" you explicitly authorise Market Mirae and Stripe (our payment processor) to charge the payment method on file at the price displayed on the pricing page, automatically at the start of each billing cycle, until you cancel. The exact amount and billing frequency will be confirmed before your payment is processed.
• Prices may change with 30 days' advance notice. Your continued use after the effective date constitutes acceptance.
• You may cancel at any time from your Account page; access continues to the end of the current paid period. No partial-period refunds are issued except as described in Section 5.
• Free trials (if offered) convert to a paid subscription at the end of the trial unless cancelled beforehand. You will be notified at least 5 days before any trial ends.

5. Refund Policy

You may request a refund within 7 days of any subscription payment via the in-app refund form (Account → Request refund) or by emailing support@marketmirae.com. Approved refunds may be returned to your card or issued as in-app credit. See the full Refund Policy for details. Consumer protection laws (including EU Consumer Rights Directive, UK CRA, and Australian Consumer Law) may grant you additional rights that these Terms cannot limit.

6. No Liability for Purchases

We do not buy, sell, broker, escrow, or otherwise participate in any transaction. Trust scores, price-fairness verdicts, alternative suggestions, and risk warnings are AI-generated estimates and may be incomplete or incorrect. You are solely responsible for your purchasing decisions and any losses arising from them.

7. Share & Earn Program

• Submit a public video link that promotes Market Mirae. We must be clearly identified.
• 2,000+ verified views → 50% off your next subscription cycle.
• 20,000+ verified views → full refund of your last subscription payment.
• View counts are verified by our team. Bot, paid, embedded, or auto-played views are disqualified.
• One reward per submission. Rewards may not be combined or transferred.
• We may reject any submission that is misleading, defamatory, illegal, or otherwise off-brand.

8. User Responsibilities

• Submit only URLs you have the right to share.
• Do not use the Service to harass or defame sellers.
• Do not scrape, reverse-engineer, or resell our output without permission.
• Do not attempt to circumvent credit limits, paywalls, or security controls.
• Do not upload malicious, deceptive, or unlawful content.

9. Data Processing Agreement (DPA)

We act as the data controller for your personal data. Our third-party service providers (Google, Stripe, OpenAI, Anthropic, ScraperAPI, Resend, Upstash) act as data processors under written Data Processing Agreements. A full list of processors and the safeguards in place for international data transfers is set out in our Privacy Policy (Section 4 and 5). By agreeing to these Terms you acknowledge this arrangement.

EU/EEA and UK users: Standard Contractual Clauses (SCCs) and, where applicable, the EU-US Data Privacy Framework, govern transfers of your personal data to the United States.

10. Privacy & Your Rights

Your privacy rights (access, correction, erasure, portability, restrict processing, object to automated decision-making) are described in full in our Privacy Policy. You may exercise most rights directly from your Account page, or by emailing privacy@marketmirae.com. We will respond within 30 days.

11. Limitation of Liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or related to the Service is limited to the amount you paid us in the preceding 12 months. We are not liable for indirect, incidental, or consequential damages. Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be limited by law.

12. Modifications

We may update these Terms. Material changes will be surfaced in-app at least 14 days before they take effect. Continued use after the effective date constitutes acceptance. You may also choose to delete your account at any time instead of accepting revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. EU/EEA consumers retain the protections afforded by mandatory provisions of their local law.
